法の「効力の根拠」を問い直す - 法実証主義と自然法論の対立を超えて - Thinking about the Reasons why we should obey the Law 小田桐, 忍 法実証主義 自然法論 法の効力 ケルゼン ラートブルフ ハート ドゥウォーキン[ legal_positivism natural_law_theory validity_of_law Kelsen_Radbruch Hart,_Dworkin 小論は、大陸法系と英米法系とに大別しつつ、それぞれ法実証主義と自然法論という法哲学上の二大潮流の観点から、法の効力論を取り上げ、両者の問い直しを試みた。そのため、小論の2-1と3-1は前者の法実証主義に与する見解になり、2-2と3-2は後者の自然法論に与する立場からの論述になった。最後に小論は、わが国における法の効力の根拠について考察するとき、井上茂の学的営為が重要であることを指摘し、かかる井上の見解を紹介した。 We know of two mainstream legal philosophies, namely, legal positivism and natural law theory.Therefore, when we think about reasons to obey the law, we must refer to the problem from these twostandpoints. In this paper, the author will analyze some theories of legal philosophers, Hans Kelsen,Gustav Radbruch, H.L.A. Hart, and Ronald Dworkin.
