Education based on respect for the child was talked as a theory of child's right; that is, Rousseau had written to respect the child in his "Emile ou de l'education" that is called the book discovering a child. After that, the Rousseau's thought of respecting for a child was developed from 19th century to 20th century, it bore fruit in the thought and activity of Johann Heinrich Pestalozzi and Friedrich Frobel during the 19th century. And at the head of 20th century, it was revived as an idea of the New Education Movement by John Dewey, Ellen Kay, etc. Kay, in her "The century of the child", asserted the right of the child to select its own parents, and the right to live, and the fight to develop; so to speak they are the child's rights for self. On the other hand, Janusz Korczak asserted "das Recht des Kindes zu sein, was es ist", so his theory of the child's fight, that is "Das Recht des Kindes auf Achtung" which was included in the Geneva Declaration of the Rights of the Child that incorporated Ellen Kay's theory of the child's right, can be said the child's right is in itself. Then making comparison between the Kay's theory of the child's right and Korczak's theory of the child's right, the former's center of gravity is in the rights of children for their social and living conditions, the latter's center of gravity is in the child's right for itself. In conclusion, it can be said that the first generation of the thought on child's right is Rousseau and Robert Owen who endeavored to assure the welfare and education of poor children; the second generation is Kay who wrote emphatically the right of the child; and the third generation is Korczak who claimed concretely the child's fight for itself.}, pages = {61--71}, title = {子どもの権利論の系譜と展開-E・ケイとJ・コルチャックを焦点として-}, volume = {46}, year = {2009} }
